Proudly Serving Atlanta, Georgia and the entire metropolitan area.
Notable Academic and Professional Background
The Law Firm of Sean J. McIlhinney prides itself in fighting for justice and winning. Sean graduated cum laude from North Carolina State University in 1991 and completed law school at Georgia State University in 1995, where he again graduated with honors, cum laude, and was a member of the Law Review.
Upon graduation, Sean accepted employment at King & Spalding, the premier law firm in Atlanta and the Southeast, where he worked for approximately three years in the Products Liability Department as a litigator representing clients such as General Motors and Brown & Williamson, a tobacco manufacturer, in national high profile/high stakes cases.
Firm History and Practice Areas
In late 1998 Sean opened the firm and decided to fight for justice by representing individuals arrested and accused of crimes and people injured in accidents. He also realized that many firms over charged for simple matters and started doing incorporations and preparing wills and trusts for the Atlanta community.
The firm has maintained its focus and Sean's primary practice areas areas are: (1) Criminal Defense, DUI, and Traffic Tickets (in fact Sean is sometimes referred to as the "DUI PRO" and "Traffic Ticket Pro"; (2) Civil Litigation with a focus on serious personal injuries and wrongful death cases (the firm has handled and settled cases in excess of 1 million dollars each; and (3) Wills and Trusts.
Experience
Practicing law for approximately 10 years, Sean has gained extensive experience negotiating and litigating civil and criminal cases. Specifically, with respect to his criminal practice, Sean has developed strong and good relationships with all metro county prosecuting offices, including Atlanta, Fulton, DeKalb, Gwinnett, Cobb, Clayton, Douglas, Paulding, Forsyth, Henry, Hall, Habersham, Upson, Pike, Monroe, Spalding, Griffin, Rockdale, Thomaston, Alpharetta, Braselton, College Park, Chamblee, Doraville, Decatur, Duluth, East Point, Kennesaw, Lawrenceville, Marietta, Roswell, Smyrna, Stone Mountain, Jonesboro, McDonough, and Union City. Consequently, the client always receives strong and effective representation whether the case is resolved by negotiation or trial.
A large majority of the firm's clients in the criminal arena are young adults (minors) who have been arrested or charged with a traffic violation or alcohol related offense and their driver's license and criminal record are on the line. The firm also specializes in representing out-of-state drivers (especially North Carolina) and commercial truck drivers because the penalties for these drivers are often times extremely harsh, even for what may seem to be a very minor offense such as speeding.
Unfortunately, many defendants, some who are even represented by lawyers, unknowingly plead guilty or no contest to many crimes or traffic violations not realizing the collateral consequences of the entered plea. As a result, often times the Defendant is later notified by mail that his or her driver's license is revoked or suspended as a result of the plea that was entered. Sean personally evaluates your case and clearly explains your options, the elements of the alleged charge, and potential liability so there are no surprises.
With respect to his civil practice, Sean primarily focuses on serious personal injury and wrongful death cases, often times resulting from medical malpractice or auto accidents. However, Sean has handled serious personal injury cases representing plaintiffs who have suffered significant injuries from random incidents such as an antenna falling from a cell phone tower or a professional NFL coach throwing his golf club in disgust after a poor shot which struck his caddy directly in the face. The one constant is that Sean does not handle a large volume of cases so that your case is handled and litigated properly and receives the care and attention that it deserves! Sean only handles his personal injury cases on a contingency fee basis and prides himself in getting the top dollar for his cases. In fact, within the last two years, Sean has settled two personal injury cases, each in excess of 1.4 million dollars.
Philosophy
The driving force behind the firm's philosophy is personal attention and quality representation. Also, Sean believes that legal fees for simple matters are often times overpriced. To this end, the firm handles wills, trusts, uncontested divorces, incorporations, name changes, and quitclaim deeds at at a fair and affordable price. In fact, Sean has prepared hundreds of wills and truly enjoys doing so because (a) wills are so important to have (especially for parents with minor children) and (b) he gets a chance to meet his clients in a friendly relaxed atmosphere.
The firm is unique because Sean guarantees and delivers excellent customer service. He provides FREE PHONE OR IN PERSON CONSULTATIONS which are not rushed, weekend and evening appointments are available, and all phone calls are returned promptly.
If you are need of legal assistance in any of the above areas, do not hesitate to call the firm for a FREE consultation.
